Travel terms and conditions




  • 1. Organizer
    of all group trips in the catalogue and special information is, unless otherwise stated, JCS International Services GmbH, Am Obstgarten 48, 54317 Osburg, Germany. The general terms and conditions of JCS International Services GmbH are set out below.

  • 2. PRIZES
    Our prices include all services mentioned in the travel descriptions.

  • 3. REGISTRATION
    With the registration / travel confirmation JCS International Services GmbH offers the conclusion of a binding travel contract.

  • 4. DOWN PAYMENT / BALANCE PAYMENT
    A deposit of 25% of the travel price is due upon receipt of the registration/travel confirmation.
    The balance must be paid 60 days prior to Tour start. In the case of payments from abroad, charges for foreign bank transfers shall be borne by the customer.

  • 5. CHANGES, CANCELLATION OR ABORTION OF THE TRIP
    We reserve the right to change the advertised programme if this does not result in an unacceptable impairment for the traveller or if force majeure makes this necessary. We reserve the right to cancel a group trip if the tour guide is injured or is ill and no replacement can be determined, or if force majeure such as storm, riot or strike make this necessary. In all cases in which we must cancel this tour, we will refund the travel price pro rata for the remaining travel days.
    In the event of an accident for which you are responsible, you are not entitled to another motorcycle or a refund of the motorcycle rental fee.
    Further claims against us cannot be asserted in any of the aforementioned or similar cases.

  • 6. WITHDRAWAL FROM THE TRIP
    In case of withdrawal from the booked journey the following fees are due:
    a.) up to 60 days before departure 15% of the tour price
    b.) 59-40 days prior to departure 25% of the tour price
    c.) 39-20 days prior to departure 50% of the tour price
    d.) 19-5 days before departure 75% of the tour price
    e.) 90% of the tour price in case of later cancellation or non-attendance.
    Should you or we succeed in filling the space freed up by your cancellation elsewhere, the fees are limited to a maximum of 25% of the tour price.
    The traveler is free to take out a travel cancellation insurance policy on his own cost.

  • 7. REGULATIONS AND LAWS
    The participant is responsible for compliance with passport, visa and customs regulations. The participant is solely responsible for compliance with the traffic laws, even if he follows the tour guide. All disadvantages resulting from the disregard of laws and regulations shall be borne by the causer.

  • 8. OBLIGATIONS OF THE PARTICIPANT
    Each participant drives on own responsibility and own risk and is liable within the scope of the legal liability for all damage, which he causes to fellow traveler`s or third parties. In order to ensure a smooth and safe journey for all participants, it is necessary that each participant adheres to the laws. Should a participant fail to comply with this provision despite a warning from the tour guide, he/she may be excluded from the group tour. In this case, a claim to contractually guaranteed travel services only exists in relation to accommodation, meals and any transfers, but not to further assistance by the tour guide or a reduction in the tour price. Should we or other participants suffer damage as a result of the misconduct of a participant, we reserve the right to assert claims for damages.

  • 9. LIABILITY OF THE ORGANIZER
    We are liable within the scope of the duty of care of a prudent businessman for the conscientious preparation and execution of the booked journey, as well as for the careful selection of the service providers. Our liability is excluded or limited, as far as a damage of the traveler was caused neither roughly negligently nor deliberately, or alone the fault of a service provider meets. Our liability is in any case limited to the travel price. Liability for delay is excluded.
    In terms of motorcycle rental, we are intermediaries. Should the ordered Harley Davidson® model not be available in exceptional cases, the lessor must provide an equivalent or better Harley Davidson® model.

  • 10. COMPLAINTS
    Should you have any reason for complaint, it must first be reported to your tour guide and requested to be changed. If he is not able to eliminate the cause of your complaint within a reasonable period, your complaint must be made to us in writing within one month of the end of the trip. After this time, claims can only be asserted against us if you were culpably prevented from adhering to this deadline.

  • 11. PLACE OF JURISDICTION
    You travel with a German company. The place of jurisdiction for both parties is Trier. For the mediated Harley-Davidson® the jurisdiction of the lessor is valid.

  • 12. SAVING DATA
    Data that you make available to us will be stored in an EDP system and protected against misuse in accordance with the DSGVO.

  • 13. PRICE CHANGES
    The invalidity of individual provisions of these travel conditions shall not result in the automatic invalidity of the entire contract. Rather, both parties undertake to find a regulation which comes closest to the meaning of the original version. Otherwise, the statutory provisions shall apply.

  • 14. LIABILITY INSURANCE
    Please note that the fully comprehensive insurance of the motorcycle rental company includes a liability of € 1,120,000. A further protection of the participant against damages caused by the third party during the trip is the sole responsibility of the participant. The tour operator is in no case responsible to ensure this.

  • 15. REGULATIONS PRESTIGE MOTORCYCLES SAS
    Minimum age driver: 25 years
    Maximum age driver: 75 years
    Possession of motorcycle driving license: at least 2 years

    Insurance included:
    - theft, fire
    - natural disasters
    - accidental damage
    - Liability in the amount of € 1. 120. 000

    Deposit
    The deposit for the motorcycle is payable to Prestige Motorcycles SAS in form of cash or credit card and the deposit also corresponds to the deductible in case of damage or theft.
    Please note that you pick up the motorcycle one day after your arrival and return it one day before your departure.
